Plant Breeder’s Rights has been law in Australia and New Zealand for many years. What does this mean for you as a gardener? Plants are protected for many reasons. Plant breeding is an expensive business with all the costs of facilities, labour and trials. Often it takes several years before the plant gets to market because there are many steps which all take time. It is expensive so breeders need to be recompensed if new plants are to continue to come through the industry to keep gardens interesting. Royalties are collected through the sale of labels.

Many labels you will find will have something like ‘Eligibility of this plant as a registrable plant variety under section 43(6) of the Plant Breeders Rights Act 1994 will expire on 15/1/07”. On some occasions the plants are never submitted for registration so one needs to check the website to confirm this. The website is: http://pericles.ipaustralia.gov.au/pbr_db/
